Executors

Executors ensure that your wishes - expressed in your Will - are carried out after your death. You can choose between one and four executors. Two is often the best number to choose. It's an important role, so choose carefully. Are they likely to be around when you die? Are they happy to take on this role? Are they trustworthy?

Where shall I keep my Will?

Keep a copy yourself, but the best place for the Will itself is probably with your solicitor at Milburns. Do tell family where the original is being kept.

What is a living Will?

Some people are worried about being given medical treatment which is unacceptable to them, or being kept alive through artificial means against their wishes. It is possible to make an advance directive or statement about these matters. This 'living Will' sets out in advance what kind of medical treatment you wish or do not wish to receive, in the event of you subsequently becoming incapable of giving or refusing consent or of communicating your views. If a living Will is made properly, then doctors or other medical practitioners are obliged to comply with your wishes to refuse treatment. However, doctors cannot be required to give a particular form of treatment, unless they agree it is clinically necessary.

A solicitor at Milburns can help you prepare a living Will in accordance with your personal wishes and requirements. You should also discuss this with your GP and with members of your family so that they are aware that you have made a living Will.

What happens after my death?

Your solicitor at Milburns will advise your executors what they need to do. They may need a 'Grant of Probate'. If the Will is in order, a Grant of Probate will be issued by the Probate Registry. Your executors can then start to collect your assets and, when this is complete, distribute the money and property to those people and organisations you want to benefit. This may take some months.
